About PulsarTrove

PulsarTrove provides website design, setup, configuration, deployment, technical administration, managed hosting arrangements, website editing tools, and related support services for independent businesses.

These Terms apply to the use of the PulsarTrove website and, where applicable, to PulsarTrove managed website services unless different terms are agreed in writing for a particular client or project.

Website Services and Managed Service Model

A PulsarTrove website package provides access to a managed website service. PulsarTrove designs, configures, deploys and technically administers the website, while the client may manage everyday content through the website editor and other features made available to them.

Purchasing or renewing a PulsarTrove website package does not constitute the sale or transfer of PulsarTrove’s underlying website software, templates, source code, website editor, backend systems, Worker code, deployment systems, reusable components, design systems or other proprietary technology.

The client receives the right to use the configured PulsarTrove website for the duration of the active service arrangement, subject to these Terms and any agreed package conditions.

Submitting an enquiry does not create a contract or guarantee availability. Pricing, scope, payment arrangements, domain arrangements and any additional work will be confirmed before PulsarTrove commences a client project.

Domains Acquired by PulsarTrove

Where PulsarTrove acquires or registers a domain name for use with a client website, the domain will ordinarily remain registered and administered through PulsarTrove unless otherwise agreed in writing.

While the client’s PulsarTrove service remains active, the client is granted the right to use that domain for the client website provided through the service.

Payment for a PulsarTrove website package, annual service renewal or third-party domain registration cost does not by itself transfer the domain registration to the client.

A PulsarTrove-acquired domain may be made available for separate purchase and transfer by the client. Any domain purchase or buyout price, administration or transfer fee, third-party cost and applicable transfer conditions will be disclosed or agreed before the transfer proceeds.

Domain transfers are subject to the rules, restrictions, waiting periods and technical requirements imposed by the applicable registrar, registry or other third-party provider.

Client-Owned Domains

Where a client already owns a domain and authorises PulsarTrove to configure or administer it, ownership or registration rights in that domain remain with the client.

The client remains responsible for maintaining access to any account they retain, paying provider charges for that domain where applicable, and providing the access or permissions reasonably required for PulsarTrove to perform the agreed service.

Domain Transfer and End of Service

Transfer of a domain away from PulsarTrove does not include the transfer of the PulsarTrove website platform, templates, source code, website editor, backend systems, hosting configuration, deployment systems or other PulsarTrove intellectual property.

If a PulsarTrove-managed domain is purchased and transferred by the client, the client may use that domain with another website or provider after transfer.

Unless otherwise agreed in writing, termination of the PulsarTrove managed service will end access to the PulsarTrove-hosted website and website editor.

The client may retain or receive client-owned content in accordance with these Terms, but the PulsarTrove website software itself is not included in a domain transfer or cancellation.

Intellectual Property

PulsarTrove retains all rights, title and interest in its business name, branding, website designs, templates, source code, editor software, backend systems, Worker code, deployment systems, reusable components, documentation, workflows and other original materials created or owned by PulsarTrove.

No PulsarTrove intellectual property is sold, assigned or transferred to a client unless PulsarTrove expressly agrees otherwise in writing.

Clients must not copy, reproduce, redistribute, resell, reverse engineer, extract or provide PulsarTrove source code, templates or proprietary systems to another person or service provider without written permission.

Client-Provided Content

Clients retain their rights in text, photographs, videos, logos, branding and other material they provide to PulsarTrove.

By supplying content for use on a PulsarTrove website, the client authorises PulsarTrove to store, process, resize, convert, display, publish and otherwise use that material as reasonably necessary to provide the managed website service.

The client is responsible for ensuring they have the rights, permissions and consents required to use material they provide.

PulsarTrove may refuse or remove content where there are reasonable concerns regarding legality, intellectual-property infringement, security, provider rules or other serious risks.

Website Editor and Client Access

Where a website editor is supplied, the client may use it to manage the content and features made available through that editor.

Editor login details must be kept confidential. The client is responsible for activity undertaken using credentials supplied to them unless access has been compromised through a failure attributable to PulsarTrove.

The website editor does not provide access to PulsarTrove source code, hosting accounts, deployment systems or other administrative infrastructure.

Pricing, Renewals and Third-Party Costs

PulsarTrove package pricing and renewal pricing are stated on the applicable pricing page or client quotation.

Domain registration, hosting, storage, bandwidth and other third-party services may be charged separately at the relevant provider’s current rates.

Third-party provider charges may change independently of PulsarTrove. Where reasonably practicable, PulsarTrove will inform the client before incurring a material additional third-party cost on their behalf.

Additional design, development, administration, content-entry or support work outside the included service may be charged separately at the applicable PulsarTrove rate or quoted before work proceeds.

Support and Maintenance

PulsarTrove’s managed service includes the technical administration and routine support described in the relevant website package.

Clients are expected to manage ordinary content changes through the supplied editor where those functions are available.

Major redesigns, additional pages or functionality, substantial content work, bulk administration, unusual media requirements or work outside the ordinary scope of the managed service may incur additional charges.

PulsarTrove does not promise unlimited development, administration, storage, bandwidth or support under a standard website package.

Third-Party Services

PulsarTrove may rely on third-party providers for services including domain registration, DNS, hosting infrastructure, storage, security, email or other technical functions.

Those providers operate independently and may change their services, pricing, limits, terms or availability.

PulsarTrove is not responsible for matters outside its reasonable control arising solely from the acts, outages, policies or systems of third-party providers, although PulsarTrove may assist with technical administration where this forms part of the client’s service.

Availability and Changes

PulsarTrove aims to keep its website and managed client websites reasonably available, but uninterrupted or error-free availability is not guaranteed.

Temporary interruption may occur because of maintenance, security issues, technical faults, provider outages, upgrades or other operational requirements.

PulsarTrove may make reasonable changes to its service, infrastructure or technical systems where necessary to maintain security, compatibility, performance or continued operation.

Cancellation and Termination

A client may request cancellation of their managed website service subject to any applicable payment, renewal or cancellation terms agreed for the service.

When the managed service ends, access to the PulsarTrove website and editor may be disabled and the PulsarTrove-hosted website may cease operating.

A PulsarTrove-acquired domain does not automatically transfer to the client when service ends. A client who wishes to obtain the domain must separately arrange any applicable domain purchase and transfer.

Termination of service does not transfer PulsarTrove intellectual property to the client.

Any client-owned material that PulsarTrove is reasonably able and permitted to provide may be returned or made available in an appropriate form, subject to any agreed service conditions and outstanding obligations.

Disclaimer

Information on the public PulsarTrove website is provided for general and promotional purposes.

PulsarTrove does not guarantee that all public website information will always be complete, current or suitable for every business or circumstance.

Any specific project requirements should be confirmed with PulsarTrove before purchasing or proceeding with a service.

Limitation of Liability

To the extent permitted by applicable law, PulsarTrove is not liable for indirect, incidental, special or consequential loss arising from use of the PulsarTrove website or managed service.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right, remedy or other protection that cannot lawfully be excluded under applicable law.

Changes to These Terms

PulsarTrove may update these Terms as its services, pricing model, technology or legal obligations change.

The current version and latest revision date will be published on this page.

Changes will not retrospectively alter a separately agreed written arrangement except where required by law or agreed with the client.
